BinQuest Terms of Use
These Terms of Use (the "Terms") are an agreement between you and The KAB Group ("we", "us") governing your use of the BinQuest mobile application (the "App"). By creating an account or using the App you accept these Terms. If you do not agree, do not use the App.
Eligibility and accounts
You must be at least 13 years old to use the App. You are responsible for keeping your sign in credentials confidential and for all activity under your account. Notify us promptly at support@kabapps.com if you believe your account has been accessed without permission.
License
We grant you a limited, personal, revocable, nonexclusive, nontransferable license to install and use the App on devices you own or control, for your personal, noncommercial use, in accordance with these Terms and the rules of the app store from which you obtained it.
Your content
You keep ownership of the bin names, descriptions, notes, and photos you add to the App ("Your Content"). You grant us a license to store, copy, and display Your Content solely as needed to operate the App for you and for anyone you invite to share it. You are responsible for Your Content and confirm that you have the right to upload it. We may remove content that violates these Terms or applicable law.
Acceptable use
You agree not to use the App to store or share content that is unlawful, infringing, or harmful; to attempt to access another user's data without permission; to interfere with the App's operation or security; to reverse engineer or copy the App except where the law permits; or to use automated tools to extract data from the App.
Household sharing
When you share bins with other people, they can view and, where you allow it, edit the shared content. You are responsible for choosing whom you invite. You can withdraw sharing at any time inside the App.
Availability and changes
We may add, change, or remove features of the App at any time. We will try to keep the App available but do not promise uninterrupted service. We recommend keeping your own copies of any photos that matter to you.
Termination
You may stop using the App and delete your account at any time by following the steps on our account deletion page. We may suspend or terminate your account if you violate these Terms or if we discontinue the App. Sections of these Terms that by their nature should survive termination will survive.
Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the App will be error free or that Your Content will never be lost.
Limitation of liability
To the fullest extent permitted by law, The KAB Group will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim or fifty United States dollars.
Indemnity
You agree to defend and hold harmless The KAB Group and its officers, employees, and agents from claims arising out of Your Content or your violation of these Terms.
Governing law
These Terms are governed by the laws of the State of Indiana without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in St. Joseph County, Indiana, and you consent to their jurisdiction.
App store terms
If you obtained the App from the Apple App Store or Google Play, the terms of that store also apply. Apple and Google are not parties to these Terms and have no obligation to provide support or maintenance for the App.
Changes to these Terms
We may revise these Terms. We will update the effective date above and, for material changes, notify you inside the App. Continued use after a change means you accept the revised Terms.
