Falander Terms of Use
These Terms of Use are an agreement between you and The KAB Group ("we", "us"), the developer of Falander. They apply to the Falander mobile app and this website (together, "Falander"). By creating an account or using Falander, you agree to these terms. If you do not agree, do not use Falander.
1. Who can use Falander
Falander is for adults who look after children: parents, grandparents, other relatives and trusted caregivers. You must be at least 18 years old to create an account. Children do not use Falander and must not be given an account.
2. Your account
- Give a real email address that you control. We use it to sign you in and to contact you about your account.
- Keep your password secret and do not share your account. You are responsible for what happens under your account.
- Tell us right away at support@kabapps.com if you think someone else is using your account.
3. Family plans and join codes
A family plan is a private group of households that share the care of the same children. Every adult in a family plan can see and change the plan's calendar, children, pickups, dropoffs and check ins, and can see the other members' names and contact details. Anyone who has the plan's join code or invite link can join.
- Share the join code and invite link only with people you trust with information about your children.
- The person who started the plan is its owner and can remove any member. If someone joins who should not, the owner should remove them straight away from the Family tab.
- Add only children you have the right to add, and mark as parents only the people who are their parents or guardians.
- Treat other members and their information with respect.
4. Falander is not a safety service
Falander helps families coordinate. It does not supervise children, guarantee that anyone will arrive, or replace talking to each other. Notifications and reminders can be delayed or not delivered, for example when a phone is off, has no connection or has notifications turned off. A claim in the app is a promise between family members, not a guarantee. Always confirm important arrangements directly, and in an emergency contact local emergency services first.
5. Live location
Live check ins share the caregiver's location with the family plan for a limited time. Share your location only by your own choice, never start a live check in on someone else's phone, and never use Falander to track a person without their knowledge. Location can be inaccurate or out of date, so do not rely on it alone to decide where a child is.
6. Your content
"Content" means the names, events, notes, pickups and dropoffs, check ins and photos you add to Falander.
- You keep ownership of your content.
- You give us a limited permission to store, copy, display and transmit your content only as needed to run Falander for you and your family plan, for example to show a check in photo to the other members.
- You confirm that you have the right to add the content, including any photo of another person, and that adding it does not break the law or anyone else's rights.
- Content you add to a family plan is visible to every adult in it, and shared content stays with the plan if you leave or delete your account while other members remain.
7. Content and behavior that is not allowed
You must not use Falander to upload or share objectionable content, or to behave in an objectionable way. This includes:
- Child sexual abuse material or any content that sexualizes, exploits or endangers children. We have zero tolerance for this. We remove it, close the accounts involved and report it to the appropriate authorities, including the National Center for Missing and Exploited Children.
- Sexually explicit content, including nudity.
- Harassment, bullying, threats or intimidation of any person, including other members of your family plan.
- Hate speech, meaning content that attacks or demeans people based on race, ethnicity, national origin, religion, disability, sex, sexual orientation, gender identity, age or another protected characteristic.
- Violent or graphic content, or content that promotes violence or self harm.
- Using Falander to locate, follow or contact a child or adult against a parent's, guardian's or court's wishes, including to get around a custody arrangement or protective order.
- Illegal content or activity.
- Private information about other people shared without their permission.
- Impersonating another person, or misleading others about who you are.
- Spam, malware or phishing.
- Misusing the service, such as trying to access another family plan or account, joining a plan with a code you were not meant to have, or interfering with Falander's operation.
8. Reporting a problem
If content in your family plan breaks these rules, or a member is behaving in a way that breaks them, please tell us. In the app, open the member under Family and tap Report a problem, or email support@kabapps.com with the subject "Falander report". Include your account email, the family plan name, the member's name and what happened. Do not attach illegal images; describe them instead. We read every report and normally reply within 2 business days. The plan owner can also remove a member straight away.
9. How we enforce these terms
If we believe content or behavior breaks these terms or the law, we may, without notice where the situation requires it, remove the content, remove a member from a family plan, reset a join code, suspend or close the accounts involved, and keep information needed for a legal claim or report illegal activity to the authorities. If we close your account and you think we made a mistake, email us and we will review the decision.
10. Ending your use
You can leave a family plan or delete your account at any time in the app, or by following the steps on the account deletion page. What is deleted and what is kept is explained there and in the Privacy Policy.
11. The service
Falander is currently free. If we introduce a paid plan, we will explain the price and what it includes before you are charged, and payment will be handled by the App Store. We may add, change or remove features, and we may stop offering Falander. If we plan to stop the service, we will try to give you reasonable notice.
12. Disclaimers
Falander is provided "as is" and "as available". We work to keep it reliable, but we do not promise that it will always be available or free of errors, that notifications will always be delivered on time, that location will be accurate, or that content will never be lost.
13. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, arising from your use of Falander, including a missed or late pickup or dropoff, a notification that was not delivered, or inaccurate location. Our total liability for any claim relating to Falander is limited to the greater of the amount you paid us for Falander in the 12 months before the claim and 50 US dollars. Some places do not allow these limits, so they may not apply to you.
14. App stores
If you downloaded Falander from Apple's App Store, these terms are between you and us, not Apple. Apple is not responsible for Falander or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to Falander. Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you. You confirm that you are not in a country subject to a United States government embargo and are not on any United States government list of prohibited parties.
15. Governing law
These terms are governed by the laws of the State of Indiana, United States, without regard to its conflict of law rules. Any dispute will be heard in the state or federal courts located in St. Joseph County, Indiana, unless the law where you live gives you the right to bring it elsewhere.
16. Changes to these terms
If we change these terms, we will update the effective date above. If a change is significant, we will tell you in the app or by email before it takes effect. If you keep using Falander after a change takes effect, you accept the new terms.
